Measure description
The objective of the measure is to ensure adequate protection of endangered species/biotope types in the existing protected area by 1. The measure consists of (1) the discharge and application of biological limit values for pressures of durc anthropogenic, impulsive underwater sealing to prevent negative effects on relevant species; The objective of understanding and, where necessary, regulating, on the basis of scientific evidence, anthropogenic noise levels in the sea in order to effectively protect relevant species. The measure covers the design and construction of a permanent measurement network for long-term underwater sound measurement and the derivation of international noise mapping standards, including the provision of appropriate models for the singular and cumulative assessment of regional noise pollution in German marine areas. The action will develop comprehensive noise mitigation measures to reduce anthropogenic impairments caused by impulse noise on relevant marine species for the North Sea and Baltic Sea and consider their type of conversion as a measure. As regards permanent sounds, the action will initially consist of a more intensive research phase to fill knowledge gaps. The aim is to reduce anthropogenic marine noise pollution based on further scientific evidence and to effectively protect relevant species. The measure relates to the values under development below IP6-01 as a basis for deriving concrete measures to reduce impulse and continuous sound. The action aims at developing criteria, framework conditions and practices based on Best Available Techniques and Best Environmental Practice (BAT/BEP), which serve as a guide for future-oriented environmentally friendly mariculture and a guide to licensing practices. In addition, in order to support the implementation of these guidelines and the development and implementation of BAT/BEP, the development of environmentally friendly and innovative methods in mariculture will be encouraged. The implementation of the measures provides for dialogue at regional level (HELCOM/OSPAR) and between environmental and aquaculture experts. The measure provides, in several stages, for the development and establishment of site- and conservation-specific measures necessary to create effective withdrawal and rest areas for species and habitats. To this end, inter alia, needs assessments for withdrawal and rest rooms, analyses of the spatial location of protection needs in relation to existing spatial protection measures and legal checks to identify appropriate implementation tools, as well as steps for political decision, implementation and monitoring of implementation, are planned and carried out. New emerging species, their reference and possible entry pathways should be immediately reported centrally (early warning system) in order to inform other monitoring programmes, the IMO GISIS database and other relevant databases such as AquaNIS and, where appropriate, cross-border information on the arrival of a new species. The early warning system should be linked to existing data retention, the reporting chain should be established from the outset and, if necessary, recommendations on control monitoring should be drawn up and submitted. In addition, new avenues of detection will be included. This includes, for example, the identification of species in environmental samples by metabarcoding of DNA. In addition, a decision support for immediate action (i.e. rapid removal of newly introduced species) will be established, which will include a balancing of the environmental risks of the measure. There is an analysis and follow-up of recommendations for action from a marine protection perspective, where the existing regulatory framework for mining projects is an obstacle to the achievement of the MSFD objectives or how it should better take into account the MSFD requirements in order to ensure sustainable and MSFD-compliant use of German coastal and marine waters. Marine protected areas in accordance with the Habitats Directive and VGL have been designated in coastal waters. The respective Protected Area Regulations regulate uses.
National legal transposition takes place in accordance with the implementation deadlines of the CFP: Landing obligation is fully implemented, multi-annual plans have been implemented; sustainable management of all stocks not yet achieved, but progress has been made. There are still shortcomings in achieving environmental objectives 4.1, 4.2, 4.3 and 4.4, including by-catch reduction, monitoring and control of fisheries management measures and fisheries measures to protect endangered species and habitats. This will be done by the new measure UZ4-02 in the programme of measures at 2. Cycle continued.
State Fisheries Acts and Coastal Fishing Regulations of the Coastal Federal States contain restrictions on the use of certain fishing gears, fishing protected areas, closed seasons and fishing bans for fish species. Regulations on protected areas already contain, inter alia, rules for pole-and-line fishing and areas free of use.
Legal requirements for impact assessments of uses.
Spatial planning tool to systematically coordinate usage claims in the coastal zone and its development. ICZM is guided by sustainability criteria and considers the sea and land side of coastal areas as a functional unit. The effectiveness of the measure is measured through the MSFD environmental indicators. Across all objectives, the Baltic Sea Action Plan, updated to implement the Helsinki Convention, contributes to the achievement of the objectives of the MSFD in the sense of a Category 1b measure, while continuing existing HELCOM measures. The inclusion of regional measures, plans and programmes in the national programme of measures does not alter their legal nature. The effectiveness of the measure is measured through the MSFD environmental indicators.   • Die Finanzierung der wissenschaftlichen Vorarbeiten für die Maßnahme in der AWZ ist bereits sichergestellt.

Progress description
The amendment to Section 57 of the BNatSchG extended the power to adopt ordinances on protected areas and thus created the basis for the inclusion of ecosystem-determining species and biotope types in the EEZ’s protected area regulations. A second step, which has already begun, will examine which species and biotope types should be included in the protected area schemes. In a final third step, species and biotope types are included in the Protected Area Regulations. This measure has already been implemented in the national parks of coastal waters. Full transposition is still pending in other protected areas and in the protected areas of the EEZ.
Verschiedene Einzelaktivitäten in den Ländern sind in Zusammenarbeit mit den Nationalparkverwaltungen abgeschlossen. Sie reichen von der Schulung von Natur- und Landschaftsführern über ein Kinder- und Jugendbuch zur nachhaltigen Fischerei bis hin zu Ausstellungsschwerpunkten zur nachhaltigen Fischerei und Informationsangebote für die Öffentlichkeit und Schulklassen. Die neue Dachmarke in Schleswig-Holstein „WIR Fischen.SH“ soll auch der Verbreitung von Informationen zur nachhaltigen Fischerei dienen. Weitere Aktivitäten sind gestartet, ihr Abschluss ist bis 2023 geplant. Es kommen fortlaufend neue Aktivitäten hinzu - derzeit sind Aktivitäten bis 2027 geplant.
Komponente 1 (Fischereimaßnahmen in Natura-2000 Gebieten in Nord- und Ostsee): Für die Nordsee AWZ abgeschlossen mit der Annahme der gemeinsamen Empfehlung und Vorlage an die EU-Kommission. Die EU-KOM hat einen entsprechenden Entwurf eines delegierten Rechtsakts vorgelegt mit dessen in Kraft in 2022 zu rechnen ist. Für die Ostsee AWZ wird die Annahme der gemeinsamen Empfehlung und Vorlage an die EU-Kommission“ spätestens 2023 erfolgen. Frühestens 2023 kann mit dem Inkrafttreten eines EU delegierten Rechtsakts und der vollständigen Umsetzung der Komponente für die Ostsee gerechnet werden. Fischereimanagementmaßnahmen in Natura-2000-Gebieten im Küstenmeer werden durch die jeweiligen Länder vorbereitet und umgesetzt. Mit einer Umsetzung ist bis 2027 zu rechnen. Komponente 2 (Nationale Umsetzung der Gemeinsame Fischereipolitik): Die nationale, rechtliche Umsetzung erfolgt entsprechend der Umsetzungsfristen der GFP: Die Anlandepflicht ist vollständig umgesetzt, die Umsetzung der Mehrjahrespläne ist abgeschlossen; die nachhaltige Bewirtschaftung aller Bestände ist noch nicht erreicht, aber Fortschritte erzielt. Weiterhin bestehen noch Defizite bzgl. der Erreichung der Umweltziele 4.1, 4.2, 4.3 und 4.4., u.a. bei der Beifangreduzierung, der Überwachung- und Kontrolle von Fischereimanagementmaßnahmen und Fischereimaßnahmen zum Schutz von gefährdeten Arten und Lebensräumen. Dies wird durch die Komponente 2 der neuen Maßnahme UZ4-02 in Maßnahmenprogramm zum 2. Zyklus fortgeführt. Komponente 3 (Förderung, Entwicklung und Verwendung von ökosystemgerechten und zukunftsfähigen Fanggeräten): Neue schonende Fangmethoden, um Beifänge von Schweinswalen und Seevögeln zu reduzieren, werden derzeit erprobt oder wurden bereits in die Fischerei eingeführt. Weitere Projekte wurden begonnen um die vielversprechenden Ansätze auch bis hin zur Wettbewerbsfähigkeit zu entwickeln.
Die Errichtung eines Schallregisters war für 2016 geplant und ist fristgerecht erfolgt. Seither befindet sich das Register für die Schallquellen Rammschall, Explosionsschall, und Schall aus militärischen Aktivitäten im operativen Betrieb. Seit 2018 werden stetig Erweiterungen vorgenommen, um weitere Schallquellen zu erschließen. Seit 2019 kommen weitere Bundes- und Landesbehörden der Meldepflicht an das nationale Schallregister nach. Der Schwerpunkt der Entwicklung bis 2024 wird auf dei Umsetzung der Anforderungen im Hinblick auf Dauerschalleinträge liegen. Informationen und Daten aus dem nationalen Schallregister sind seit 2020 unter dem Link https://marinears.bsh.de öffentlich zugänglich. Die aktualisierte Zeitlinie erfasst die laufenden und geplanten Erweiterungen des Schallregisters.
Es laufen vorbereitende Forschungsarbeiten zu Auswirkungen von Impulsschall durch Bau und Betrieb von Offshore-Windenergieanlagen sowie von Vergrämern („seal scarer“) auf marine Säugetiere.
Reason description
Derzeit finden auf EU-Ebene Vorarbeiten statt. In EU-Projekten (JOMOPANS/JONAS) werden Vorschläge erarbeitet, um diese Arbeiten zu unterstützen. Hierbei werden Konzepte für Belastungsindikatoren entwickelt. Basierend darauf werden dann Risiko- und Wirkindikatoren erarbeitet, welche die biologische Relevanz abbilden sollen. Hierbei müssen Frequenz, Ort und zeitabhängige Richtwerte bzw. Schwellenwerte für die Schlüsselarten (z.B. Schweinswal) entwickelt werden.
Es fehlen noch standardisierte Messverfahren und Modelle. Eine nationale sowie regionale Abstimmung läuft derzeit.
