Justification description |
Undantag tillämpas för kommersiellt nyttjade bestånd i såväl Nordsjön som Östersjön.
Undantaget motiveras främst av att Sverige inte ensamt ansvarar för alla de åtgärder som skulle behöva vidtas (29 § 1 havsmiljöförordningen), men det är även relevant att beakta att naturliga förhållanden inte tillåter en snar förbättring (29 § 4 havsmiljöförordningen).
God miljöstatus för kommersiellt nyttjade fiskar och skaldjur är starkt beroende av genomförandet av EU:s gemensamma fiskeripolitik och att den tar hänsyn till målen i havsmiljödirektivet. Detta innebär att Sverige inte på egen hand kan påverka om olika fiskarter klarar de uppsatta tröskelvärden, vilket inte är fallet idag. Detta motiverar undantag enligt 29 § 1 havsmiljöförordningen, dvs. åtgärder som Sverige inte ensamt har befogenhet över.
Fiskpopulationer påverkas av många olika faktorer men främst av olika typer av fiske, både genom direkt uttag av arter och som oavsiktliga bifångster. Även övergödningseffekter, olika effekter av habitatexploatering, samt på en mindre skala även marina däggdjurs och fåglars fångst av fisk, kan bidra till att god miljöstatus inte nås. En annan viktig aspekt är den långa återhämtningstiden som krävs för vissa broskfiskar (t.ex. hajar och rockor) då de är långlivade, har en sen mognadstid, reproduceras mindre frekvent och har låg fertilitet. Detta leder till att det kan ta lång tid innan effekter visar sig av åtgärder som genomförts, vilket motiverar undantag enligt punkt 4. Det är svårt att beräkna när god miljöstatus för fisk kan uppnås. Sverige kan komma att använda artikel 15.
Exceptions are applied under descriptor 3 for commercially exploited fish and shellfish in the North Sea and the Baltic Sea. The exception is mainly justified by the fact that Sweden itself is not responsible for all the measures that would need to be taken (Article 14(1)(a)) but it is also relevant to consider natural conditions which do not allow timely improvement (Article 14(1)(e)).
Good environmental status for commercially exploited fish and shellfish is highly dependent on the implementation of the EU Common Fisheries Policy (CFP) and that regulation taking into account the objectives of the MSFD. This means that Sweden cannot, on its own, influence whether different fish species meet the set thresholds. This justifies exceptions (Article 14(1)(a)), i.e. measures for which Sweden is not solely responsible.
Fish populations are affected by many different factors but mainly by different types of fishing, both through direct harvesting of species and as incidental by-catches. Eutrophication effects, various effects of habitat exploitation, as well as on a smaller scale the capture of fish by marine mammals and birds, can also contribute to the failure to achieve good environmental status. Another important aspect is the long recovery time required for some cartilage fish (e.g. sharks and rays) when they are long-lived, have a late maturation period, are less frequently reproduced and have low fertility. As a result, the effects of measures implemented may take a long time, which justifies exceptions under Article 14(1)(e). It is difficult to calculate when good environmental status of pelagic fish species can be achieved. Sweden may use Article 15.
