Under the Start Conditional Regulation (AnlBV), tankers and gas tankers of certain sizes are already obliged to navigate the German Bight Western Approach off the German coast at a greater depth. In order to avoid nearshore accidents such as those of the ‘MSC ZOE’, this measure should consider the adaptation of shipping route regulations internationally. The measure aims at an initiative for a legal act (order of a legal provision) to enforce the usage requirement for other specific vessels (large container ships). The measure relates to the putting into service of a new water protection vessel for the coastal waters of Lower Saxony. Multi-purpose use is foreseen: Use to combat marine pollution, trace marine pollution, monitor the consequences of polluting accidents and claim costs to polluters, assist in the detection and prosecution of marine pollution and deter intentional discharges of undesirable substances. Across all objectives, the North-East Atlantic Environmental Strategy, updated to implement the OSPAR Convention, contributes to the achievement of the objectives of the MSFD in the sense of a Category 1b measure, while continuing existing OSPAR measures. The inclusion of regional measures, plans and programmes in the national programme of measures does not alter their legal nature. The effectiveness of the measure is measured through the MSFD environmental indicators. Specific indicators may exist within the framework of the policy implementing the action and may be used to assess effectiveness. //Indicators: The actions of NEAES are linked to the OSPAR indicator system, which captures the impact of the measures (https://www.ospar.org/work-areas/cross-cutting-issues/ospar-common-indicators). The indicator system is constantly evolving.
The action has two components: 1. Environmental criteria (of the Blue Angel or any other ambitious eco-label) should be taken into account whenever possible in the case of new acquisition and operation of public and state-supported seagoing vessels, such as research vessels. These ships should serve as a model for promoting higher environmental standards in shipping. 2. Develop a model for an inclusive and internationally operational incentive system that incorporates the requirements for clean waterborne transport, is applicable to all types of ships in maritime transport and contributes to the internalisation of external costs of transport modes. The action has three components: 1. Possible amendments to the IMO Guidelines with higher requirements for discharges of waste water from exhaust gas cleaning systems. 2. The action aims to improve maritime emergency preparedness and management by improving and enhancing pollution control at sea and on the coast. The action contains 17 components, some of which have started or have already been completed, which either directly control behaviour (e.g. further development of airborne intelligence and tracking), are preparatory measures (e.g. technical concepts) or promote measures at international level (e.g. ban on the introduction of paraffin). The identification of target loads of phosphorus at the inland/marine transfer point is a crucial basis in the eutrophication context in order to develop and implement inland marine-related mitigation needs and measures. The measure is implemented in cooperation with those responsible for the MSFD and WFD action planning. The OSPAR North-East Atlantic Environmental Strategy identifies country-specific maximum nutrient inputs. The measure under the MSFD is intended solely to derive the objectives. The development of target values (and associated indicators) for inputs of phosphorus, selected pollutants and plastics (including microplastics) at the transfer point in inland/marine is the subject of the action. The action aims at developing criteria, framework conditions and practices based on Best Available Techniques and Best Environmental Practice (BAT/BEP), which serve as a guide for future-oriented environmentally friendly mariculture and a guide to licensing practices. In addition, in order to support the implementation of these guidelines and the development and implementation of BAT/BEP, the development of environmentally friendly and innovative methods in mariculture will be encouraged. The implementation of the measures provides for dialogue at regional level (HELCOM/OSPAR) and between environmental and aquaculture experts. The action is intended to complement actions on land. An information campaign focusing on seagoing ships/cruise ships, e.g. through brochures, explained films or stickers, aims to highlight the dangers of inappropriate disposal of medicines (e.g. via the toilet or run-off) to the marine environment and to raise awareness about proper disposal of old drugs on board and, as a consequence, also on land. The aim of an information campaign is to provide information on the risks that UV-filters can pose to the marine environment and to promote the conscious use of sunscreen products. Information can be provided via brochures, postcards, posters and explained films, especially in coastal resorts. The development of measures is essential to ensure that human health is taken into account in the information campaign. The measure relates to solid bulk goods and covers both damage and nutrients. Among other things, a study will identify necessary measures and policy options to ensure the acceptance of cargo residues in ports handling bulk cargo. In order to address measures to prevent and prevent the introduction and spread of non-indigenous species through biofouling, the Biofouling Guidelines (MEPC.207(62)) were adopted at IMO level in 2011. There is an analysis and follow-up of recommendations for action from a marine protection perspective, where the existing regulatory framework for mining projects is an obstacle to the achievement of the MSFD objectives or how it should better take into account the MSFD requirements in order to ensure sustainable and MSFD-compliant use of German coastal and marine waters. The action aims at actively accompanying and supporting IMO activities in reporting, locating and, where appropriate, retrieving containers overboard. An investigation of national and international accidents with significant container losses is planned. The lessons learned will feed into proposals for individual organisational and technical arrangements. If necessary, the action may seek external expertise in order to provide an independent scientific basis for any regulatory proposals. These proposals are intended to feed into the national positioning, which in turn will form part of the EU coordination for IMO discussions. OSPAR Decision 90/3 (1990) recommends that chlor-alkali plants using mercury cell technology be phased out and that they should be fully shut down by 2010. HELCOM Recommendation 23/6 (2002): Reduction of mercury emissions and discharges from the chlor-alkali industry.
The IED of 24 November 2010 forms the basis for permitting industrial installations with special environmental impact across the EU. In addition to pollutant emissions in the various media, all production processes must be taken into account in order to reduce the consumption of resources and energy and other environmental pressures during operation and after the closure of an industrial installation. Transposed into Germany by amending existing laws, in particular the • Federal Immission Control Act, • Water Management Act, • Circular Economy Act.
The Gothenburg and Aarhus Protocols are part of the United Nations World Economic Commission (UNECE) Geneva Convention on Air Pollution. * The 1998 Aarhus Protocol on Heavy Metals required States Parties to drastically reduce air pollution from heavy metals. In a further protocol in 1998, a number of UNECE countries agreed on measures to reduce emissions of persistent organic compounds (POPs). Both Protocols entered into force in 2003. * The Gothenburg Protocol considers the combined effects of pollutants and is therefore also referred to as a multi-component protocol. The aim is to combat acidification, eutrophication and the formation of ground-level ozone. To this end, the Protocol contains numerous provisions on emission reduction, monitoring, reporting, etc. and national emission ceilings (NECs) for sulphur dioxide, nitrogen oxides, ammonia and volatile organic compounds (NEC Directive, 2001/81/EC). It was adopted in 1999 and entered into force in 2005. * The 39th Ordinance implementing the Federal Immission Control Act (39. BImSchV) transposes the NEC Directive into German law. The international MARPOL Convention for the Protection of the Marine Environment of 1973 contains 20 articles of general obligations for States Parties, procedural instructions and basic rules. The practically relevant provisions for the prevention of pollution of the marine environment in relation to the various types of ship-related waste are set out in Annexes I to VI. The designation as PSSA (Particularly Sensitive Sea Areas, dt. Specially sensitive marine areas according to the IMO’s Marine Environment Protection Committee) includes: Awareness-raising, definition of mandatory deep water routes. Für Teilmaßnahmen sollen EU-Fördermöglichkeiten zur Entwicklung des ländlichen Raums (ELER-Verordnung) genutzt werden. Die Finanzierung ist noch nicht sichergestellt. Dies erfolgt im Zuge der Operationalisierung und Umsetzung des Programms.

Progress description
Measures are under way to raise awareness of Blue Engel certification. Studies have also been carried out describing the design of a possible incentive system.
Die Umsetzung der 2016 gemeldeten Maßnahme war für 2022 geplant. Infolge der Überarbeitung der Maßnahmen für 2022 wurden vollständig umgesetzte Aktivitäten durch neue Teilmaßnahmen ersetzt (z.B. umfassende und standortspezifische Erhebung über den Erhaltungszustand von Munitionsaltlasten für eine Priorisierung des möglichen Handlungsbedarfs in Nord- und Ostsee). Teilmaßnahmen, die noch nicht vollständig abgeschlossen werden konnten werden weitergeführt und teilweise präzisiert. Die Laufzeit der Maßnahme wurde an der Umsetzung der neuen Teilmaßnahmen ausgerichtet und entsprechend aktualisiert.
Reason description
Die Maßnahmenumsetzung ist komplex und erfolgt ggf. in Stufen. Die konkrete Zeitplanung ergibt sich aus dem Maßnahmenkennblatt. Zur Umsetzung: Die Umsetzung aller Maßnahmenkomponenten wurde begonnen. Es sind weitere Analysen i.R. von Folgeprojekten notwendig, um IMO Arbeiten und Entscheidungen wissenschaftlich fundiert zu begleiten. Einleitbeschränkungen und Regelung der Entsorgung sind noch nicht in allen Seegebieten und Häfen endgültig entwickelt.
