Measure description
The action includes: a) Preparation of rescue plans for oily animals for Pomeranian Voivodeship, Warmian-Masurian Voivodeship and West Pomeranian Voivodeship .; b) Regular updating of plans for both voivodeships based on the latest available substantive knowledge and detailed cooperation arrangements between entities responsible for helping oily animals; c) Organization of regular exercises in communication between the responsible entities and in carrying out a rescue operation for oily animals on the coast, at least once a year / two years. As part of the action, the best national and international knowledge and experience should be used, as well as helpful documents such as """"The rules for helping oily animals in the central Baltic Sea"""" """"(WWF Polska, 2014).
After the modification, the action consists in introducing corrections to the spatial development plans of sea areas, eliminating the shortcomings described in the column """"The essence of the problem"""". Vistula Lagoon: Thanks to the provision that the function of """"shore protection"""" includes """"the prohibition of destroying reeds, which constitute a natural protection against the damaging effects of undulations"""" and extending the shore protection function as the basic one to the vast majority of reeds not included in the basic function """"protection of the environment and nature"""", the draft plan provides generally a very high degree of protection of the key biodiversity of the littoral zone. However, here is an exception: - in the 38th water basin, liquidation of reed beds for the needs of tourism, sports and recreation has been allowed, along a section of approx. 2.7 km, adjacent to undeveloped areas of very doubtful suitability for construction (drained wet meadows).
The action was specified and modified in the direction of using modern methods of communication with the society (websites and channels in social media, websites dedicated to aquaristics or fishing, magazines: including Akwarium and Wiadomosci Wedkarskie). It is planned to involve in the information campaign representatives of science (NMFRI, Inland Fisheries Institute, Institute of Nature Conservation, Institute of Environmental Protection), environmental and social organizations such as: WWF, Polish Association of Aquarists and Polish Angling Association, as well as leading aquarium and fishing stores. Promotional materials should indicate the significant problem of alien species and their expansion, facilitated by the uncontrolled release of aquarium fish and fish used as fishing baits, as well as arbitrary restocking (not in accordance with the fishing survey). Such activities endanger native species and the stability of aquatic ecosystems. """"
The measure consists in building and launching infrastructure in the main passenger ports of the Polish coast for the collection of sewage from passenger ships and for the discharge of sewage to municipal treatment plants.
The scope of activities covers the implementation of recommendations prepared by the Interministerial Team for threats resulting from hazardous materials deposited in the maritime areas of the Republic of Poland, approved by the Council of Ministers on January 19, 2022. As a result of the work carried out, the Team developed the following recommendations for the Council of Ministers. 1. Appointment, by a new ordinance of the Prime Minister for the period until 2027 with the possibility of extension, of a team for hazardous materials deposited in the maritime areas of the Republic of Poland, whose task would be, in particular, to coordinate the cooperation of ministries responsible for activities related to monitoring and neutralization of hazards caused by dumped hazardous materials. 2. Securing financing sufficient to support the team's work and carrying out the operations to screen and neutralize the two most threatening wrecks: Franken and Stuttgart. 3. Commissioning the team to prepare a draft of special regulations (at the statutory level) comprehensively regulating the issues related to the possible removal of threats caused by hazardous materials submerged in the maritime areas of the Republic of Poland. It is initially assumed that: - the works will use the achievements and experience of the Baltic countries, including Poland, - the principles of prioritizing research will be determined on the basis of the current knowledge about the distribution and nature of threats, - on the basis of the established hierarchy of priorities, subsequent facilities and areas will be successively examined, - monitoring studies will cover, among others, the condition of the facilities and the risk of sudden releases, the distribution of toxic substances concentrations around the facilities, the risk of substance migration, substance concentrations and their impact on living organisms, - each time the result of the research will be recommendations for further treatment of the facilities, including the determination of the latest permissible dates for subsequent tests, - annual amounts will be allocated to monitoring tests, ensuring the possibility of a thorough analysis of all potential threats related to the deposition of oil derivatives, conventional ammunition and chemical weapons on the seabed within a dozen or so years.
Cyclically, at least once a year, the organization of actions such as """"Cleaning the world"""", consisting in cleaning the banks of rivers and lakes by volunteers. An information campaign to encourage the maximum number of volunteers, which will allow the action to cover as many rivers as possible on the longest sections. The action is coordinated by PGW WP and locally implemented by local governments and local initiatives with experience in organizing this type of action.
The action will consist of: - analysis of technical measures currently used in Poland to prevent waste from rainwater and general sewage systems from entering waters (m.in the universality and effectiveness of using bins in manholes, the effectiveness of settling tanks used in catching waste, methods of securing storm spillways, other methods and techniques used), - analysis of best practices and innovative solutions used in other countries, - discussion of existing problems and possible solutions in industry forums (conferences, meetings, workshops), - development of a strategic document presenting the current situation and proposed technical, organizational, educational, financial and legal solutions, - dissemination of the document by Polish Waters and industry organizations, - implementation by state authorities of legal solutions postulated in the strategy (e.g. regulations on the equipment of sewage treatment plants, rainwater drainage wells and storm spillways, places where rainwater flows into rivers) and financial solutions (e.g. co-financing programs for solutions protecting water against waste from rainwater and general sewage systems).
The action will consist in creating the best guidelines, i.e. developing technical and organizational methods for reducing impulse noise associated with the disposal of explosive charges. Domestic and foreign practices will be analyzed in this respect, e.g. methods consisting in deliberately frightening animals, deflagration of cargo, extraction and transport of cargo for disposal on land training grounds, the use of air curtains, as well as the possibility of limiting the number of days a year in which marine life is exposed to impulsive noise generated as a result of the disposal of explosives. Detailed guidelines and procedures will then be implemented by entities involved in the disposal of explosives at sea.
The action will consist in creating the best guidelines, i.e. developing technical and organizational methods for reducing impulse noise related to the neutralization of explosives. Domestic and foreign practices will be analyzed in this respect, e.g. methods consisting in intentional scaring of animals, deflagration of loads, extraction and transport of loads in order to neutralize them on land training grounds, the use of air curtains, as well as the possibility of limiting the number of days a year in which marine life is exposed to impulsive noise generated as a result of neutralizing explosives.Detailed guidelines and procedures will be then implemented by the Armed units Forces from thw Republic of Poland and other units dealing with the neutralization of explosives at sea.
In order to protect porpoises and grey seals in the Baltic Sea, underwater noise restrictions should be introduced in NATURA 2000 areas where these animals are protected. Natura 2000 areas where porpoises are protected include: Bay of Puck and Hel Peninsula PLH220032, Ostoja na Zatoka Pomorskiej PLH 990002, Ostoja Slowinska PLH 220023 and Wolin and Uznam PLH 320019. On the other hand, Natura 2000 areas in which the grey seal is protected include those mentioned above for porpoises and: the Vistula Lagoon and the Vistula Spit PLH280007, Ostoja in the Vistula Estuary PLH220044 and Trzebiatowsko-Kolobrzeski Coastal Belt PLH320017. 1. On the basis of the latest available literature, thresholds for impulse noise, behavioural response of animals and hearing impairment shall be defined, which should not be exceeded in Natura 2000 sites for marine mammals protected by the site. Underwater noise levels should be safe at the Natura 2000 border. For marine mammals, the absolute minimum is to take into account the temporary shift of the threshold of audibility (TTS) at the borders of Natura 2000 sites so that the underwater noise level is safe for these animals. For porpoises, the threshold for temporary shift of the threshold of audibility (TTS) due to the pulse noise dose is the level of exposure to SEL sound with the function of frequency weighting according to susceptibility to noise-induced hearing damage of the porpoise: 140 dB re. 1 µPa2s, and for seals with frequency weighing function for pinnipeds 170 dB re. 1 µPa2s (NMFS, 2018, National Marine Fisheries Service, Technical Guidance for Assessing the Effects of Anthropogenic Sound on Marine Mammal Hearing: Underwater Acoustic Thresholds for Onset of Permanent and Temporary Threshold Shifts. NOAA Technical Memorandum NMFS-OPR-59, 178 p.: U.S. Dept. of Commer., NOAA 2018). Seals are less susceptible to noise-induced hearing damage than porpoises (they have higher noise thresholds), so in Natura 2000 areas where both species are protected, the porpoise criterion should be applied. However, it should be sought that Natura 2000 sites, as specially protected, have stricter criteria than TTS, if not at the level of behavioural response, then between this level and TTS. 2. Noise thresholds shall be used in environmental impact assessments of a project. EIA reports should be carried out for all offshore works that result in high levels of sound sources (for this purpose, the possibility of revising and updating types of projects that may always have a significant impact on the environment should be analysed) and should compulsorily include modelling of underwater noise propagation taking into account the unique characteristics of the project (e.g. location, level and spectrum of the sound source). 3. In addition, it is suggested to use the """"soft start"""" procedure for piling and seismic tests for 30 minutes. This procedure consists of a gradual increase in noise intensity in order to allow the animals to move away from the area of work. Another proposal is to establish a Marine Observer of Mammals and Seabirds (MMSO), which continuously observes animals during seismic surveys. 4. In addition, Natura 2000 sites should introduce limits on the maximum speed of passing ships, as well as a ban on scooters entering, thereby reducing noise emissions into their environment. Moreover, it would reduce the risk of these animals colliding with ships. The proposed noise exposure criteria values are based on the updated General Recommendation of the United States National Agency for the Management of National Marine Resources (NMFS). This agency has set thresholds for permanent and temporary hearing damage to marine mammals due to exposure to impulse noise, based on literature data
In view of the critical state of the porpoise population in the Baltic Proper, Poland, represented by the Minister responsible for fisheries, will support Commission Delegated Regulation (EU) 2022/303 of 15 December 2021 amending Regulation (EU) 2019/1241 as regards measures to reduce incidental catches of sedentary captive porpoise from the Baltic Sea (Phocoena phocoena) in the Baltic Sea (Dz. EU L 46 25.02.2022, p. 67), which includes restrictions on the use of specific fishing gear in demarcated areas and the mandate to use pingers. Due to the important problem of by-catch for marine mammals in POM, an open dialogue with the fishing community and other stakeholders will be conducted through education (workshops) and awareness (leaflets) on the need to introduce measures to limit the use of static fishing gear in selected protected areas and the benefits of these measures for the Baltic Sea ecosystem. An agreement will also be reached with the Ministry of National Defense on the use of cetacean deterrent devices – pingers in waters outside Natura 2000 areas, and in particular with the immediate vicinity of these areas (waters directly bordering Natura 2000), in which the year-round presence of porpoises is documented.
The action will consist in adding porpoise as an object of protection in the Natura 2000 area - Slupsk Bank (PLC990001), provided that the preference in seasonal terms of the occurrence of this species in the discussed area is confirmed, based on the next 2 years of research carried out as part of the State Environmental Monitoring (2021-2022) and other available monitoring data (pre-investment monitoring for the purposes of the EIA procedure). The planned action does not include porpoise monitoring, but only the use of results/conclusions from existing studies. In addition, on the basis of the results of these monitoring tests, GIOS will decide to increase / or not the number of acoustic monitoring devices in the area N2000 of the Slupsk Shoal. After obtaining the results of research confirming the preference for the occurrence and longer stay of porpoises on the Slupsk Shoal, in a situation where a higher value of positive detection days (DPD) is found, and especially minutes of positive detections in warm months, the Maritime Office in Szczecin will renew the application to the General Directorate for Environmental Protection to add this species to the list of objects of protection in the Natura 2000 - Slupsk Shoal (PLC990001) area.
The action consists in establishing in the Natura 2000 site protection plan and in the maritime development plan, a zone with temporary restrictions on use, in which people and vessels would be banned from mid-February to the end of September. This prohibition would not apply to: - performing tasks in the field of nature conservation, - the performance of tasks by state services, - movement of transport vessels between the mouth of the Vistula and the Gulf of Gdansk at a speed of up to 10 knots. Information on the introduction of the zone should be placed on the paths of the Mewia Lacha reserve and the Natura 2000 Ostoja area in the Vistula Estuary, marked with specialized signal buoys on the border of the zone of limited movement of units, educational boards should be updated with information on the planned protection zone of gray and common seals and information on seal protection in the area of the Vistula Estuary should be promoted. The zone includes the areas of occurrence of meadows in the period 1999-2020 and a buffer with a width of 300-500 m from these regions. The existing nature trail with an observation tower was excluded from the zone. The Water Police will be responsible for complying with and enforcing the restrictions. In addition, we propose to set up two cameras covering the sea and land area to give the possibility of continuous monitoring. In parallel with the creation of a zone in the estuary of the Vistula as part of the Natura 2000 protection plan, an amendment to the Regulation on the protection of animal species should be introduced, consisting in placing the grey seal and the common seal under zonal protection with a radius of the zone of 500 m. Thanks to this, in the event of the emergence of new resting places of both species on the Polish coast, a simple and effective tool for their protection will be available.
The action consists in limiting anthropogenic activity, causing a high level of impulse noise (as a result of primarily piling and explosion) in the area of the Pomeranian Bay and the Central Shoal to months that are important for porpoises (for the Pomeranian Bay July - September and February - March, and for the Central Shoal May - August). Such restrictions could be set in the framework of giving opinions and agreeing on the implementation of projects related to maritime areas that are related to impulse noise emission and as part of activities related to the removal of unexploded ordnance.
